  1. 1. Conditions of Use for the Telco phonecards
    1. 1.1. This sets out the terms on which Telco Global Ltd ("Telco", "us", "we") will provide various pre-paid phone cards (the "Cards") to you, the customer. By using the Cards you agree to be bound by the following terms and conditions (the "Conditions of Use") and acknowledge that we provide the Cards to you on these terms.
    2. 1.2. You must accept the Conditions of Sale and Use as a condition of you using the Cards. If you do not accept the Conditions of Use then you must not use the Cards. You acknowledge that use of the Cards will be deemed to be an acceptance by you of the Conditions of Use.
  2. 2. General
    1. 2.1. All relevant payment terms (the "Payment Terms") in relation to your use of the Cards are disclosed and can be accessible on the pricing link on our website at www.telcocards.com. All special terms of use in relation to specific Cards (the "Special Terms of Use") are disclosed and can be accessible on the telco cards store link.
    2. 2.2. Please note that some Cards may be subject to a daily and/or monthly maintenance charge, the amount of which will be listed on your individual cards . These charges are debited from the total value of your Card and become applicable from the date of the first use of your Card.
    3. 2.3. Further information about specific offers, products or services can be obtained by contacting our customer service department by email to customerservice@telcocards.com
    4. 2.4. You must inform us of any problems relating to your Card within 7 days of purchase. You can do so by contacting us on the Customer Services number printed on the reverse of the card or by writing to Telco Global Ltd, c/o Telecom Support Centre, 5 Portal Way, London, W3 6RT. You may be required to submit your Card and proof of purchase for us to assess the validity of any claim you make. Where a Card is found to be faulty, a replacement Card will be sent to you containing an equivalent amount of call credit as that which was held on the faulty Card.
  3. 3. Restrictions and limitations
    1. You shall not use, nor allow any other(s) to use, the Cards:
      1. a. for any improper, immoral or unlawful purpose;
      2. b. to send a communication which is, or is intended to be, a hoax call to emergency services, or which is defamatory, offensive, abusive, obscene, menacing, threatening, harassing, harmful, invasive of another's privacy, sexist, racist or violent or impersonates another person;
      3. c. to violate or infringe any rights of, or to cause unwarranted inconvenience or anxiety to, any other person;
      4. d. in such a way that may damage, interrupt, destroy, corrupt, limit or affect the operation, functionality or quality of the Cards, the network or any telecommunications system used to provide the Cards;
      5. e. fraudulently or illegally or contrary to any relevant standard or code;
      6. f. for the purpose of re-sale to third parties; or
      7. g. for use in business or for commercial purposes (including but without limitation through the use of automatic diallers, or in other ways not conforming with standard consumer usage). These Cards are for consumer use only.
  4. 4. Our rights
    1. We reserve the right to terminate, restrict, suspend or cancel the use of all or part of any Card or set of Cards where we reasonably believe
      1. a. that any Card or set of Cards is being used by you or on your behalf for commercial purposes or otherwise contrary to these Conditions of Use;
      2. b. that any Card or set of Cards is being resold by you or on your behalf (whether or not for commercial gain) or in other way being exploited for commercial gain without Telco's express written permission;
      3. c. where we reasonably believe that there has been fraudulent activity (for example, where our systems detect that the Cards are used to make an unusual amount of phone calls originate from the same telephone number or set of telephone numbers that would be inconsistent with normal consumer use).
      Where this happens, you will not be entitled to any refunds.
  5. 5. Warranty and Liability
    1. 5.1 Your use of the Cards is at your, and others who use your Card, sole risk. The Cards and any other product or service which may be provided through or bundled with the Cards are provided "as is" and "as available" for your use, without warranties of any kind. Your statutory rights remain unaffected.
    2. 5.2 Please note that Telco will not be liable in the event of loss or theft of your Card(s).
    3. 5.3 The Card is a consumer/residential product and is not designed to be used by customers in connection with the conduct of their, or their employers' or contractors', commercial activities. If you choose to do so, it is entirely at your own, and your employer's or contractor's, risk.
    4. 5.4 Telco does not make any representations or warranties in respect of your ability to access or use the Cards at times or locations of your choosing (including any network or software operating in connection with the Cards). Telco will, however, use reasonable skill and care to provide and maintain the availability of the service provided through the Cards.
    5. 5.5 Except as provided by law, we exclude all liability for the accuracy (or inaccuracy) or reliability of any material or other information provided or made available by any third party in relation to the Cards. Telco will however use reasonable skill and care in updating and maintaining all information available on its website. Your statutory rights remain unaffected.
    6. 5.6 Telco does not endorse, warrant or guarantee any product or service offered in conjunction with the Cards by a third party, and will not be a party to, or responsible for monitoring, any transaction between you and any such third party.
    7. 5.7 Telco shall not be liable for any failure or delay in performance of our obligations under these Conditions of Use caused by matters beyond our reasonable control.
    8. 5.8 Telco shall not be liable for (i) any secondary loss howsoever caused; (ii) for any loss of data, profit, revenue or business or wasted expenditure, howsoever caused, or (ii)i any loss not reasonably foreseeable by us when this Agreement commences, arising from your use of the Cards or any other product or service that may be bundled with the Cards.
    9. 5.9 Without limiting the above paragraphs (and except for Telco's liability for death or personal injury caused by its negligence, or for any fraud or fraudulent misrepresentation, for which Telco's liability shall be unlimited), the liability of Telco under or in connection with these Conditions of Use (whether arising in negligence or otherwise) will not under any circumstances exceed the greater of (a) five times the retail value as listed on the individual Card in relation to which the liability has arisen; or (b) £100, regardless of the cause or form of action. Your statutory rights are unaffected.
  6. 6. Indemnity
    You indemnify us against any action, liability, claim, loss, damage, proceeding and/or expense (including legal costs) suffered or incurred by us, arising from, or which is directly or indirectly, related to your breach or non-observance of any term of these Conditions of Use.
  7. 7. Intellectual property
    1. 7.1 We own, or are otherwise licensed to use, all intellectual property in the Cards (including the names, logos, trademarks, copyright, content, design, text, graphics, software and any other material appearing on the Cards), unless indicated otherwise. Subject to these terms of use, we grant to you a non-exclusive and non-transferable licence to use the Cards for the purposes of telephone calls.
    2. 7.2 You agree that you will not, either directly or indirectly, infringe our intellectual property or other property rights (or any of our licensors' rights) in the Cards and will not, either directly or indirectly, reproduce, modify, transmit, copy, adapt, sell, publish distribute or communicate the Cards or anything contained within the Cards (in part or in full) or otherwise use the Cards in a way which will infringe our intellectual property or other property rights (or any of our licensors' rights), except as permitted by law or with our prior written consent.
  8. 8. Use of personal information
    1. 8.1 We respect your personal information and undertake to comply with applicable data protection legislation in place from time to time.
    2. 8.2 We do not hold details of names or other Personal Information that can identify a living individual, unless this is specifically provided to us by you during the course of any dealings you may have with our customer services department. We do however collect details of the telephone number of the phone(s) that has been used in order to make calls on your Card, the details of phone numbers called, the call duration and other information that is necessary in order to administer the service provided to you through the Cards.
    3. 8.3 This information is only used for the following purposes:
      1. a. to administer the credit balance on your Card;
      2. b. to carry out any activity or disclosure in connection with a legal, governmental or regulatory requirement on us or in connection with legal proceedings, and for the prevention and detection of crime or fraud and the prosecution of offenders or suspected offenders; or
      3. c. to carry out activities connected with the running of our business such as personnel training, quality control, network monitoring, testing and maintenance of computer and other systems and in connection with the transfer of any part of our business in respect of which you are a customer or a potential customer. We may also use your information for the purpose of testing our internal systems and developing new products and services.
    4. 8.4 Your personal information may be held and used by us for a number of purposes and We may use third parties to support us with purposes which include, without limitation:
      1. a. administering your Card balance
      2. b. carrying out any activity or disclosure in connection with a legal, governmental or regulatory requirement on us or in connection with legal proceedings, and for the prevention and detection of crime or fraud and the prosecution of offenders or suspected offenders; or
      3. c. carrying out activities connected with the running of our business such as personnel training, quality control, network monitoring, testing and maintenance of computer and other systems and in connection with the transfer of any part of our business in respect of which you are a customer or a potential customer. We may also use your information for the purpose of testing our internal systems and developing new products and services.
    5. 8.5 If You would like us to tell you what information we hold about you, if any, please write to: The Data Controller, Telco Global Limited at the above address. We may charge a £10.00 administration fee; please quote your name, the telephone number you have used to make calls (if any) and the applicable Card pin number on all requests
    6. 8.6 You should be aware that if we are requested by the police or any regulatory government authority investigating suspected illegal activities to provide your personal information or information concerning your activities whilst using any of the cards, we shall do so.
    7. 8.7 We may disclose to third parties aggregated data relating to the use of the Cards provided that a single individual is not identifiable in such data.
    8. 8.8 We will not collect any personal information about you unless you have chosen to give it to us. Do not give it to us if you do not want it collected.
    9. 8.9 We may use information we have collected about you for improving customer service, and to respond to your queries.
    10. 8.10 When you speak to us on the phone, some calls may be monitored or recorded in case we need to check we have carried out your instructions correctly and to help improve our quality of service.
  9. 9. Amendments
    We are entitled at our sole discretion to change, add or remove any part of these Conditions of Use and to change, withdraw, add or delete any features of the Cards or a related promotion at any time (together, the "Changes"). Where this happens, we will provide you with notice by posting or uploading the Changes on our website no less than 21 days before such changes or amends are due to take effect (the "Notice Period"). If you do not agree to any such Changes, your sole remedy is to return your Card to us to arrive no later than one working day after expiry of the Notice Period. Your continued use of the Cards after the expiry of the Notice Period constitutes an agreement by you to abide by and be bound by the Changes.
  10. 10. Invalidity and inconsistency
    If any part of these Conditions of Use is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these terms will not be affected. In the event any terms contained on the Cards or within our website conflicts with these terms of use, then these terms of use will prevail to the extent of such inconsistency.
  11. 11. Complaints
    1. 11.1 There may well be occasions when you are unhappy with the Service that we provided to you. In these cases, We will endeavour to be fair and efficient in handling any complaint you should have and to process your complaint confidentially.
    2. 11.2 If you have a complaint, please send us a letter to this address (Telco Global Limited, c/o Telecom Support Centre, 5 Portal Way, London, W3 6RT).
    3. 11.3 We will endeavour to give you an answer within 5 working days and will provide you with a likely timescale for resolving the dispute. We will keep you informed about the progress of your complaint.
    4. 11.4 We undertake to check our system regularly for handling complaints and we welcome any suggestion you may have in relation to how this system may be improved.
  12. 12. Governing law and legal notices
    1. 12.1 Law and Jurisdiction: these terms shall be governed by and interpreted in accordance with English law and the courts of England shall have exclusive jurisdiction to resolve any disputes between us.
    2. 12.2 Assignment: Telco reserves the right to assign or subcontract any of its rights or obligations under this Agreement.
    3. 12.3 No Waiver: If you or we fail to exercise any right or remedy under this Agreement, that failure won't operate as a waiver of that right or remedy, or prevent it from being exercised subsequently.
  13. 13. Entire agreement and relationship
    These Conditions of Use (as amended from time to time), together any Special Terms of Use applicable to your specific Card, contain the entire agreement between you and us relating to your use of the Cards and supersedes any previous agreements, arrangements, undertakings, representations or proposals, written or oral, between you and us in relation to such matters.
